BeingShips provides logistics and shipping solutions through a technology platform that connects shippers with courier partners. Our services include but are not limited to:

• Order fulfillment and shipping management
• Real-time tracking of shipments
• Automated documentation generation
• Cash-on-delivery (COD) management
• Returns and exchange processing

3. User Accounts

3.1 Account Creation

To access certain features of our Services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account

3.2 Account Termination

We may suspend or terminate your account if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose
• Attempting to gain unauthorized access to our systems
• Interfering with or disrupting the Services
• Uploading or transmitting viruses or any other malicious code
• Using the Services to ship prohibited items (see Section 5)
• Misrepresenting your identity or affiliation with any person or organization

5. Prohibited Items

The following items are strictly prohibited from being shipped through our Service:

• Illegal substances or drugs
• Weapons, firearms, and ammunition
• Hazardous materials
• Perishable goods requiring refrigeration
• Live animals
• Counterfeit or pirated goods
• Any item prohibited by law in the origin or destination country

6. Pricing and Payments

6.1 Service Fees

Shipping rates are determined based on:

• Package dimensions and weight
• Destination
• Service level selected
• Any additional services requested

6.2 Payment Terms

You agree to:

• Pay all charges associated with your use of the Service
• Provide valid payment information
• Authorize us to charge your payment method for all applicable fees

6.3 Price Changes

We reserve the right to change our pricing at any time, with notice provided to existing customers.

7. Shipping and Delivery

7.1 Shipping Estimates

Delivery time estimates are provided for guidance only and are not guaranteed. Actual delivery times may vary due to:

• Weather conditions
• Customs delays
• Transportation disruptions
• Other unforeseen circumstances

7.2 Delivery Attempts

Our courier partners will make reasonable attempts to deliver your shipment. If delivery cannot be completed:

• The package may be returned to our facility
• Additional fees may apply for redelivery attempts

8. Liability Limitations

BeingShips acts as an intermediary between shippers and courier partners. While we strive to ensure reliable service, we are not liable for:

• Delays caused by weather, natural disasters, or other force majeure events
• Loss or damage to shipments beyond the declared value
• Incorrect addresses or recipient information provided by the shipper
• Customs delays or import/export restrictions

Our maximum liability for lost or damaged shipments is limited to the lesser of the declared value or ?5,000 per shipment.

9. Intellectual Property

All content on the BeingShips platform, including:

• Text
• Graphics
• Logos
• Software

is the property of BeingShips or its content suppliers and protected by intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

10. User Content

By submitting any content (reviews, comments, etc.) to our platform, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content in connection with our Services.

11. Termination

We may terminate or suspend your access to our Services:

• Immediately for violations of these Terms
• With 30 days notice for any other reason

Upon termination, your right to use the Services will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of our Services after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana.

14. Dispute Resolution

Before filing any legal action, you agree to:

• Notify us in writing of the dispute
• Attempt to resolve the dispute through good faith negotiations

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and BeingShips regarding the Services.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision will not be considered a waiver of those rights.

15.4 Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control.
